Facts
Steinhauer (defendant) offered to sell a property and included an option to hold the offer open for 90 days for $1 in consideration as well as a fee of $200 to be paid by the time the 90 days accrued. M. B. Sulzberger (plaintiff) paid Steinhauer $1 in consideration for the option to purchase the property and paid the required $200 before the 90-day deadline. Steinhauer refused to accept the $200 payment and refused to go forward with the sale of the land. Sulzberger brought suit against Steinhauer, and the court found in favor of Sulzberger, granting specific performance. Steinhauer appealed.
