Facts
Vernon Summit (defendant) was charged with two counts of sexual assault—cunnilingus and fellatio—on a six-year-old girl. At trial, Summitt sought to introduce evidence of a prior sexual act of the victim, including fellatio, but not cunnilingus. The district court excluded the evidence on the grounds of Nevada’s rape shield law, which limited admission of evidence of a sexual assault victim’s prior sexual experience. The jury convicted Summitt on both counts. He appealed.
