Facts
Sun Capital Partners, Inc. (Sun Capital) (plaintiff) sued Twin City Fire Insurance Co. (Twin City) (defendant) for breach of an insurance policy. Twin City wanted to depose Sun Capital’s top executives and general counsel. Sun Capital moved to quash the depositions, asserting those personnel had no special knowledge about the events that resulted in the lawsuit and did not participate in any unique way. Instead, Sun Capital offered the attorney who defended it in the underlying lawsuit as its corporate representative to be deposed about the case.
