Facts
When traveling on business, Super Glue Corporation (plaintiff) employees rented cars from Avis Rent A Car System, Inc. (defendant). Super Glue believed that the wording of Avis’s standard rental agreements led to its being overbilled by Avis. Super Glue sued Avis in state court, alleging several causes of action that entitled it to recover monetary damages from Avis. Five of the causes of action alleged that Avis breached its obligation of good faith and that Avis’s rental agreements were unconscionable. When the trial court dismissed those five charges, Super Glue appealed to the appellate division.
