Facts
Voters in Douglas County, Nevada, approved a sustainable-growth initiative that would allow no more than 280 new dwelling units to be built each year. This 280-unit annual cap represented a 2 percent increase in population based on the most recent census figures. This percentage would decrease each year as the 280 units were added to Douglas County’s population base. Douglas County’s master plan provided for a growth rate of between 2 percent and 3.5 percent annually in order to manage growth. Douglas County and several developers filed a lawsuit challenging the initiative as being inconsistent with the county’s master plan. The trial court ruled that the sustainable-growth initiative was inconsistent with the county’s master plan and granted summary judgment to Douglas County. Those in support of the initiative appealed.
