Facts
Steven Suvada and John Konecnik (plaintiffs) were business partners who distributed milk. They purchased a used tractor from White Motor Company (White) (defendant). White installed the brake system on the tractor, which was manufactured by Bendix-Westinghouse Automotive Air Brake Company (Bendix) (defendant). Three years after Suvada and Konecnik purchased the tractor, the brake system failed and the tractor hit a bus, causing damage to the tractor, the bus, and the bus’s passengers. Suvada and Konecnik sued White and Bendix for the cost of repairing the tractor, the bus, and the settlement of the claims of the bus passengers. The trial court dismissed some of Suvada and Konecnik’s claims related to damage to the bus and personal-injury claims for failure to state a cause of action. The appellate court found that Suvada and Konecnik had stated causes of action for all damages it claimed against White and Bendix on a theory of implied warranty. Bendix appealed to the Illinois Supreme Court.
