Facts
Todd Hannegan (defendant) contracted to purchase a truck from Larry Swalberg (plaintiff) for $2,500. Hannegan was a minor, but his age was apparently not discussed. Hannegan paid $640 on the date of sale and was supposed to pay the balance three months later. Rather than paying, however, Hannegan disaffirmed the contract based on his minority. Swalberg sued Hannegan to enforce or undo the contract. Hannegan returned the truck to Swalberg while Hannegan was still a minor. The truck was worth $700 in its returned condition. The court granted judgment for Swalberg, ordering Hannegan to pay $1,160, which was the balance of the contract less the truck’s returned value. Hannegan appealed.
