Facts
Synergistic International, LLC (plaintiff) was a windshield-repair company that used the trademark “The Windshield Doctor.” Synergistic sued Jody Korman (defendant) for using the name “Glass Doctor” in conjunction with her windshield-repair business. The district court awarded summary judgment and damages to Synergistic. Korman appealed, alleging that the court had erred in finding trademark infringement and in awarding damages.
