Facts
While working, an employee of Pennsylvania Railroad (defendant) was overcome by heat. The employee died without receiving care or assistance from Pennsylvania Railroad. The deceased employee’s estate (plaintiff) brought suit against Pennsylvania Railroad and won judgment. The state supreme court reversed the judgment. The decedent’s estate appealed. The New Jersey Court of Errors and Appeals granted certiorari.
