Facts
The Board of Supervisors of Fairfax County (the board) (defendant) enacted the Beverage Container Ordinance (the ordinance), which required a minimum cash-refund value on containers for nonalcoholic beverages. Charles Tabler (plaintiff) of Foodarama Supermarket brought suit, contending that the board did not have the power to enact the ordinance. The trial court held that the board was authorized to enact the ordinance and dismissed Tabler’s complaint. Tabler appealed.
