Facts
Tabor & Company (plaintiff) was a Nevada corporation doing business in Illinois. Tabor contracted with McNall Brothers Grain Service (defendant), a Wisconsin corporation, for a series of grain deliveries. The deliveries were to Tabor’s location in Illinois. McNall breached the contract. Tabor filed suit in Illinois for breach of contract. Separately, McNall filed suit in Wisconsin, admitting its breach but seeking to minimize its damages. The Illinois court granted Tabor’s motion to enjoin McNall from pursuing the suit in Wisconsin. McNall appealed.
