Tagliere v. Harrah’s Illinois Corp.
United States Court of Appeals for the Seventh Circuit
445 F.3d 1012, 2006 AMC 1290 (2006)
- Written by Carolyn Strutton, JD
Facts
Harrah’s Illinois Corp. (Harrah’s) (defendant) owned and operated a riverboat casino on a navigable portion of the Des Plaines River in Illinois. The riverboat had been moored to a pier attached to the land in that location for approximately two years. Lucille Tagliere (plaintiff) was leaning against a stool playing a slot machine in the casino when the stool collapsed. Tagliere fell as a result and was injured. Tagliere sued Harrah’s in federal district court under admiralty law. Harrah’s moved to dismiss the suit for lack of jurisdiction, and the district court granted the motion. Tagliere appealed.
