Facts
Ahmed Tagouma (plaintiff) filed a claim for workers’ compensation. Tagouma’s employer contested the claim and hired Investigative Consultant Services, Inc. (ICS) (defendant), a private investigative firm, to conduct surveillance of Tagouma. Michael Zeigler (defendant) was assigned to surveil Tagouma. Using a zoom lens, Zeigler videotaped Tagouma for 45 minutes praying in the Islamic Center in front of a glass window. The surveillance was conducted from a parking lot 82 yards away from the Islamic Center. Tagouma sued ICS and Zeigler for invasion of privacy by intrusion on seclusion. The trial court granted ICS and Zeigler’s motion for summary judgment. Tagouma appealed.
