Facts
Terry Sanders (defendant) agreed to write, direct, and produce a short documentary about lithography for Tamarind Lithography Workshop, Inc. (Tamarind) (plaintiff). After the film was completed and screened, a dispute arose over the parties’ rights and obligations under the agreement, leading to litigation. Tamarind and Sanders then entered into a written settlement agreement that imposed obligations on both parties, including an obligation by Tamarind to give Sanders a screen credit on the finished film. Sanders performed his obligations, but Tamarind did not provide the stipulated credit. Both Tamarind and Sanders filed new claims for breach of contract, which were consolidated and brought to trial. Sanders sought injunctive relief. The jury found that Tamarind had breached the settlement agreement and awarded $25,000 in damages to Sanders, but the court denied Sanders injunctive relief. Sanders appealed. The California Court of Appeal granted certiorari.
