Facts

The Sandanger (defendant) was a freighter that caught fire off the coast of Baja California. Two tugs, the Mikimiki and the Sea Eagle, arrived on the scene and agreed to assist the Sandanger on a no-cure, no-pay basis. Crewmembers from the tug showed great courage and skill in boarding the Sandanger, fighting the fire, and securing lines to tow the vessel 350 miles north towards San Diego. The tugs eventually beached the Sandanger when it was in danger of sinking. Cargo worth $1,000,000 was saved, and the salvaged vessel was worth $47,000. The claims for salvage by the owner of the Sea Eagle, Tampa Tugs & Towing, Inc. (plaintiff) and the owner of the Mikimiki were consolidated.
