Facts
TAS Rights Management, LLC (TAS) (plaintiff) was the exclusive licensee and administrator of the name and likeness of Taylor Swift and the trademark TAYLOR SWIFT. TAS also was the exclusive licensee of the trademark THE 1989 WORLD TOUR. The trademarks were registered with the United States Patent and Trademark Office. TAS filed a lawsuit against Jevon Barber and several others (collectively, Barber) (defendants), alleging that Barber sold and distributed Taylor Swift and 1989 World Tour merchandise near the concert venues in which Swift was performing on her tour. TAS asserted that Barber was guilty of trademark infringement, use of a counterfeit mark, trademark dilution, violating the Tennessee Consumer Protection Act, and violating the Tennessee Personal Rights Protection Act. TAS sought a permanent injunction. Barber failed to file an answer to the complaint by the deadline to do so. TAS filed a motion for a default judgment.
