Taylor v. Holt
Tennessee Court of Appeals
134 S.W.3d 830 (2003)
- Written by Paul Neel, JD
Facts
Before he died, Steve Godfrey drafted a will on his computer leaving all of his property to his girlfriend, Doris Holt (defendant). The will identified Holt by her first name alone. Godfrey used a computer-generated signature to sign the will in the presence of his neighbors, Hershell and Teresa Williams, who signed the will in Godfrey’s presence. Godfrey’s sister (plaintiff), his only heir, contested Godfrey’s signature. Holt filed affidavits in which the Williamses attested to seeing Godfrey sign the will using a computer-generated signature in their presence. The trial court ruled in Holt’s favor. Godfrey’s sister appealed.
