Facts
Teitelbaum (plaintiff) signed a lease with Direct Realty Co. (defendant) for storefront premises in Hempstead, New York. Teitelbaum was to take possession of the premises on July 1, 1938, and begin operating a drugstore. The previous tenants refused to vacate the premises, and Direct Realty brought suit to vacate them. The tenants vacated the premises in January of 1939. Teitelbaum then brought this suit against Direct Realty for damages.
