Facts
Telco Communications Group, Inc. (Telco) (plaintiff) was a long-distance telecommunications provider. Race Rock of Orlando, L.L.C. (Race Rock) (defendant) purchased five long-distance calling cards from Telco. Upon receiving an invoice from Telco, Race Rock realized that the numbers on one of the cards had been stolen. The invoice included over $92,000 in charges for various international calls to several nations. Race Rock informed Telco that none of its employees had made the calls. Nevertheless, Telco held Race Rock liable for the balance and sued Race Rock for breach of contract when it did not pay the disputed amount. Race Rock filed a motion to dismiss.
