Facts
Telewizja Polska USA, Inc. (Polska) (plaintiff) sued Echostar Satellite Corporation (Echostar) (defendant) in federal district court. Echostar proffered evidence in the form of potentially damaging archival images of Polska’s website, which Echostar obtained from a commercial vendor. Echostar accompanied the proffer with the vendor’s affidavit that the images were genuine. Polska filed a motion in limine to exclude the images, arguing that the vendor had not been in business long enough to establish a track record for reliability and that, therefore, Echostar failed to meet Federal Rule of Evidence 901’s authentication requirement.
