Facts
Tenneco, Inc. (plaintiff) operated an oil refinery and terminal on land it owned along the Mississippi River. The Oil, Chemical & Atomic Workers Union, Local 4-522 (OCAW) (defendant) was the union that represented Tenneco’s refinery workers. The labor agreement between Tenneco and the OCAW expired, and the OCAW began a strike at the refinery. The strike resulted in mass picketing, violence, and acts of intimidation. Tenneco eventually sued the OCAW, seeking an injunction prohibiting the OCAW from picketing on Tenneco’s property. The trial court granted the injunction, except for picketing on the levee along the Mississippi that formed one border of Tenneco’s site. The trial court held that picketing along the levee was an allowable public use of the levee under Louisiana state law. Tenneco appealed, alleging that picketing on the levee was not an allowable use and that the injunction should be extended to include the levee property as well.
