Facts
Ned Terrell (defendant) struck James Wilson in the eye with a brick rendering Wilson completely blind, having previously lost his other eye. Terrell was charged with the crime of mayhem. At trial, the judge instructed the jury that if Terrell struck Wilson “from feelings of malice” toward him, Terrell should be found guilty. Terrell was convicted and he appealed.
