Facts
Tessera, Inc. (plaintiff) and Micron Technology, Inc. (defendant) were engaged in federal-court litigation. Tessera asked Hynix Semiconductor America, Inc. (Hynix), which was not party to the action, to produce potentially relevant electronically stored information (ESI) in Hynix’s possession. After Hynix spent over $70,000 to assemble more than 100,000 pages of responsive documents, Tessera asked Hynix to run a second data sweep on an expanded list of search terms. Although the added search terms were likely to turn up additional relevant ESI, Hynix objected to the burdensome cost of a second search, which could involve over two million pages of additional ESI. Tessera filed a motion to compel production.
