Facts
The plaintiff and the defendant were business competitors. The defendant sent a false report to the plaintiff’s current and prospective customers, stating that the U.S. government had conducted a study and found that the plaintiff’s product was only 40 percent as effective as the defendant’s. The plaintiff brought suit. The defendant moved for summary judgment, admitting the truth of the allegations, but claiming that the dissemination of the reports was not actionable.
