Facts
Tetra Laval (Tetra) (plaintiff) arranged for a merger and acquisition of Sidel. Tetra was a major producer of plastic food containers, and Sidel produced machines that created plastic containers. The Commission of European Communities (the Commission) (defendant) would not allow the merger to go forward. Tetra sued in the Court of First instance to have the Commission’s decision reversed.
