Facts
Texaco Trinidad, Inc. (Texaco) (plaintiff) operated an offshore buoy that aided in the delivery of petroleum products. Texaco required ships using the buoy to use pilots supplied by Texaco. A vessel owned by Afran Transport Co. (Afran) (defendant) sought to use the buoy. Texaco supplied Afran’s vessel with a pilot but failed to give the pilot a radio so he could communicate with the vessel’s crew. Due to communication issues between the crew and the pilot, the vessel crashed into the buoy. Texaco sued Afran in personam for damages.
