Facts
Ivan Villareal (plaintiff) was a student at Texas Southern University’s Thurgood Marshall School of Law (the school) (defendant), a state institution. The school required its students to maintain a 2.0 grade-point average. The school dismissed Villareal for failing to do so. Villareal sued the school, arguing that the dismissal unconstitutionally took away Villareal’s protected property interest without due process of law.
