Facts
The Government of the Lao People’s Democratic Republic (Laotian government) (defendant) and Thai-Lao Lignite (Thailand) Company, Ltd. (TLL) (plaintiff) contractually agreed to arbitrate any contract dispute in Malaysia, a disinterested, third-party nation. A dispute arose between the parties, and a Malaysian arbitration panel rendered its judgment in TLL’s favor. TLL obtained a federal district court’s judgment to recognize and enforce the award in the United States. After finding that the arbitrators had exceeded the scope of their authority, the highest Malaysian court set aside the arbitration award and ordered a new round of arbitration. The Laotian government returned to the American court and moved to vacate the court’s earlier judgment.
