Facts
Rita Thakore (plaintiff) was injured by a press manufactured by Universal Machine Company of Pottstown, Inc. (Universal) (defendant). After the incident, Thakore’s employer, CIBA Vision, created an accident-investigation report. Thakore sued Universal for negligence in the design and manufacture of the press. At trial, Thakore sought to introduce the accident-investigation report into evidence. Universal filed a motion to exclude the report on the ground that it was hearsay and not an admissible business record.
