Facts
The Annie Lord (defendant) was knocked down by a squall and filled with water. The Flora L. Oliver (plaintiff) found the Annie Lord and endeavored to tow it in. The Flora L. Oliver towed the Annie Lord for several miles before the Annie Lord had to be abandoned due to the weather. The Flora L. Oliver’s crew members set up torches and lights so they could find the Annie Lord later and took the Annie Lord’s crew onboard to protect them from exposure. Shortly thereafter, the Flora L. Oliver took the Annie Lord’s crew to shore. The Annie Lord was ultimately saved after the Flora L. Oliver alerted another vessel in the area that could rescue the vessel. However, the towing by the Flora L. Oliver neither helped nor hindered the Annie Lord’s ultimate recovery. The Flora L. Oliver sued under a salvage claim.
