Facts
The Luna, a Norwegian vessel, was carrying cargo across the Atlantic when it was struck and sunk at sea by the Belgenland (defendant), a Belgian steamship. The Belgenland rescued the surviving members of the Luna’s crew, including its master (plaintiff). The Belgenland brought the Luna’s crew to Philadelphia, and the Luna’s master immediately sued the Belgenland under civil and admiralty law. The Belgenland’s counsel objected to the jurisdiction of the court over the matter. The district court proceeded, however, and awarded damages to the Luna. The decree was affirmed upon appeal to the circuit court, and the Belgenland then appealed to the United States Supreme Court.
