Facts
A merchant hired a man to carry a package of goods from London to Southampton. The goods inside the package consisted of a type of dye. Instead of going to Southampton the man broke open the package, took out the goods, and hid them. The goods ended up in the custody of the Sheriff of London who was sued by the owner. The court considered whether the bailee who broke open the package could be found guilty of larceny.
