Facts
The river Banne ran between counties Antrim and Londonderry in Ireland. Within the river Banne, in navigable waters approximately six miles from the sea, was a salmon fishery. Sir Randall Mac Donnell (plaintiff) obtained from the king (defendant) a grant to the territory of Rout, which adjoined the river Banne near the salmon fishery. The grant conveyed to Mac Donnell multiple hereditaments, including fisheries in or within Rout in county Antrim. Mac Donnell filed a petition, claiming that the king’s grant gave to Mac Donnell the exclusive right of fishery.
