Facts
An appellant (plaintiff) brought an appeal to the Japan Supreme Court, challenging the constitutionality of capital punishment. The appellant argued that the provisions of the criminal code allowing for capital punishment violated Article 36 of the Constitution of Japan, which absolutely forbade any cruel punishment.
