Facts
Attorney Martin Black (defendant) borrowed money from a client. Black promised to pay the client a usurious interest rate, left the client unsecured, did not inform the client that the transaction was illegal or that the client had a right to separate representation, and used the client to obtain a personal loan. Black did not intend to deprive his client of property or deceive him. Black repaid the client, and although the client was exposed to potential damage, he suffered no loss. Black made full disclosure to the Florida Bar (the bar) (plaintiff). The bar brought a disciplinary action against Black.
