Facts
The barge No. 19 was being towed by the tug Gypsum King in the East River in New York City when the barge collided with the steamship Jumna. After this first collision, the No. 19 and the schooner Gypsum Emperor both collided into a railroad pier. Multiple complaints and cross-complaints were filed among the parties in federal court. The district court judge dismissed all of the complaints, holding that the evidence had failed to show any negligence on the part of any of the vessels and that the collisions were therefore the result of an inevitable accident. The parties appealed.
