Facts
Dunham (plaintiff) brought an action in federal district court under admiralty law against the New England Mutual Marine Insurance Company (the insurance company) (defendant) to recover for a loss under a marine-insurance policy. The insurance company appealed the admiralty jurisdiction. Following a division of opinion among the judges in the circuit court, the issue of jurisdiction came before the United States Supreme Court.
