Facts
The California Development Co. (defendant) diverted water from the Colorado River for irrigation purposes. The diversion was located in Mexico. The diverted water flooded New Liverpool Salt Co.’s land in California. New Liverpool sued to stop the damage to its land, and the court ruled in favor of New Liverpool and enjoined California Development from diverting water in a way that damaged New Liverpool’s land. California Development appealed to the United States Court of Appeals for the Ninth Circuit, arguing that the district court could not enjoin its activities in a foreign country.
