Facts
A man (the workaway) (plaintiff) was employed as a workaway on the vessel the Tashmoo (defendant). A workaway received transportation, subsistence, and a small salary. The workaway here was assigned work as an assistant steward. During the voyage, the Tashmoo’s engine failed, and the vessel was carried offshore and into great danger. The workaway was ordered to fix the Tashmoo’s radio. At some risk and danger to himself, he ultimately connected a radio signal and contacted another vessel that came to the Tashmoo’s aid. After the Tashmoo was saved, the workaway sued for a salvage award.
