Facts
The Team Working for You (TWY) (defendant) was formed as a committee by five candidates for the Macedonia City Council. TWY published a campaign advertisement in The News Leader newspaper. The advertisement included statements that an opponent running for the city council, Patricia Spraggins, was currently campaigning against industrial growth and overdevelopment in Macedonia. In 1997, Spraggins filed a complaint against TWP and its individual members with the Ohio Election Commission (the commission) (plaintiff). The commission found that the statements in the TWY advertisement violated the state law prohibiting any person from disseminating false statements concerning a candidate, with the knowledge that the statement was false or with reckless disregard for whether the statement was false. TWY appealed, and the trial court upheld the commission’s decision. TWY appealed to the Ohio Court of Appeals.
