Facts
George Otis and Jonathan Thaxter (plaintiffs) claimed that they owned three-quarters of the schooner Tilton. Otis and Thaxter sued Schenck, McCabe, and Smith (defendants), claiming that Schenck, McCabe, and Smith had wrongfully taken possession of the ship. Schenck, McCabe, and Smith alleged that they had obtained title to the entire ship by purchase. Otis and Thaxter denied that the sale was valid.
