Facts
The Democratic Republic of Congo (DRC) (defendant) and its central bank defaulted on debt owned by Themis Capital, LLC (plaintiff). The debt was restructured in 1980. DRC defaulted in 1990. In 1991, 1997, and 2003, the DRC’s vice minister of finance and governor of the central bank both signed debt-acknowledgment letters to extend the statute of limitations on Themis’s potential claims on the debt. In 2009, Themis filed suit to recover the debt in the United States District Court for the Southern District of New York.
