Facts
Shari Thibeault and Steven A. Brackett were a couple who cohabitated for six years and rehabilitated the home in which they lived. When the couple separated, Thibeault sued Brackett and received a judgment in a small-claims court in Maine to recover her personal property. Thibeault then sued Brackett in a Maine trial court for damages and restitution for her contributions to the improvements and rehabilitation of the home. The trial court denied Brackett’s motion to dismiss based on res judicata (claim preclusion) but ruled for him on his counterclaim for a loan, which it offset against Thibeault’s recovery on her unjust enrichment claim. Brackett appealed.
