Facts
Skousen & Hise (defendant) was a contracting company conducting blasting operations on a highway. Skousen & Hise used dynamite to conduct the blasting, and W. W. Thigpen (plaintiff), a residential owner living near the blasting site, suffered damage to his home from the rocks and dirt cast from the blasting. The blasting also caused Thigpen’s property to vibrate. Thigpen brought suit against Skousen & Hise for the damage done to his property. The trial court instructed the jury to find for Thigpen if Skousen & Hise’s actions caused the damage to Thigpen’s property, regardless of any negligence. The jury found in favor of Thigpen and awarded him damages for the harm to his property caused by both the rocks and the vibrations. Skousen & Hise appealed.
