Thoburn v. Sunderland City Council
England and Wales High Court of Justice
[2003] QB 151 (2002)
- Written by Elliot Stern, JD
Facts
The European Union passed a law requiring retailers to use metric units. This law was enforceable under the domestic law of the United Kingdom through the European Communities Act 1972, which incorporated the substantive law of the European Communities (the Community)—later to become the EU—into UK law. The law was in conflict with a UK national law that allowed retailers to use imperial units. The UK law was arguably enacted later in time than the EU law.
