Thomas v. Bannum Place of Saginaw

United States District Court for the Eastern District of Michigan
421 F. Supp. 3d 494 (2019)

Facts

As part of a wrongful-death action, Ceaya Thomas (plaintiff) filed a motion to compel discovery from Bannum Place of Saginaw (Bannum Place) (defendant) in federal district court. The court granted the motion in part and denied it in part. The court’s order noted that Thomas was entitled to payment of reasonable expenses for work performed by Thomas’s attorney in connection with the motion. Thomas’s attorney submitted a bill of costs for $38,409.97 for 104.85 hours of work, despite the motion to compel being relatively simple and straightforward. Bannum Place objected, arguing that the request was grossly excessive.
