Facts
Michael Thomas (plaintiff) filed an action under Title VII of the Civil Rights Act of 1964 in federal district court against his former employer, Resort Health Related Facility (the facility) (defendant). Thomas claimed that the facility had illegally engaged in discrimination based on race, sex, and national origin in suspending his employment and sought backpay for his lost wages. After Thomas had filed his action, Thomas and the facility engaged in settlement negotiations. During the negotiation, the facility offered to reinstate Thomas’s employment. The facility did not attempt to settle Thomas’s discrimination claim or Thomas’s right to receive backpay for his lost wages through the offer. Thomas rejected the offer of reemployment. The facility then argued that Thomas could not receive backpay for lost wages following the rejection of the offer. The facility moved for partial summary judgment on the matter of backpay following the rejection. The court considered whether the facility’s offer was admissible as evidence.
