Facts
The State of Florida (plaintiff) prosecuted Ronald Anthony Thomas (defendant) for murder and armed robbery. Trial evidence established that the victim owed Thomas $10 in cash, and that Thomas approached the victim with a drawn gun and demanded repayment. The victim denied that he owed the $10. In the course of the ensuing struggle, Thomas shot and killed the victim. Thomas requested a jury instruction that a creditor's good faith attempt to collect a debt excuses the creditor's use of force against the debtor. The judge refused Thomas's request. The jury convicted Thomas for both murder and armed robbery. Thomas appealed to the Florida District Court of Appeal.
