Facts
Nicole Thompson (plaintiff) sued Autoliv Safety Technology, Inc. and TRW Automotive U.S. LLC (TRW) (defendants) in federal court, alleging that the two companies’ negligence resulted in damages that severely limited Thompson’s ability to participate in a variety of activities. However, posts and images that TRW obtained from Thompson’s public social-media profile showed Thompson fully engaged in those activities. In discovery, TRW asked Thompson for broad access to the electronically stored information (ESI) she maintained on her social-media accounts. Thompson responded by producing a limited amount of heavily redacted ESI. TRW moved to compel discovery of Thompson’s complete and unredacted social-media ESI. Thompson contested the motion on the grounds of irrelevance.
