Facts
Thorne (plaintiff) and Deas (defendant) jointly owned a boat. Deas made a gratuitous promise to Thorne that Deas would acquire insurance on the boat. Deas failed to do so, and the boat wrecked on its next voyage. Thorne brought a negligence action against Deas for his nonfeasance in failing to purchase insurance on the boat, and the jury returned a verdict in favor of Thorne.
